how do you file contempt of court in Polk County Iowa?
in Des Moines Iowa, what is the process for filing contempt of court? my ex is refusing to let me see my daughter on my court ordered weekend...what is the best process for proving she is denying me visititation?

- The police will not arrest her because it is considered a civil issue, not a police issue. Believe it or not, the only time someone can get arrested is if they don't pay child support, not for denying visitation though. By law, you can show up with the police and the court order, but she doesn't have to give her daughter up to you. All the police can say to you guys is, "deal with it in court" I suggest getting a lawyer now because at this moment, there is nothing legally you can do unless you feel she is an un-fit mother, then there is lots you can do.
- You take her back to court, along with evidence and (hopefully) witnesses. Take a tape recorder and let her know you are taping the conversation.
- First, make sure that you are complying with the order by giving the child's mother any advance notice of intent if it is specified in the order. Start keeping a log of everytime you are denied visitation and the reason or circumstances around the denial. Always take somebody with you when you go to pick the child up, as a witness and for your own protection. If you have a camera phone, record the event. If you are denied visitation, don't call the police to the location (they won't get involved) but DO go to the police station and tell them you wish to file a police report for being denied visitation. They will document the violation officially. Do it every time. Once you have all your evidence compiled, see an attorney about having a Motion for Enforcement (and possibly a Motion for Contempt) filed. Good luck
